Principles of personal data processing

SOPO s.r.o. companies with registered office at Modletice 191, ID: 47534265; SOPO-SERVIS s.r.o. with registered office at Modletice 1, ID: 26119781; SOPO GASTRO s.r.o. with registered office at Modletice 191, IČO: 08379815 (hereinafter referred to collectively as "SOPO" or "Administrator") as joint administrators within the meaning of Article of the General Data Protection Regulation (Regulation (EU) 2016/679) ("GDPR") process your personal data for the performance of its business activities consistently in accordance with applicable regulatory regulations in the field of personal data protection.

This Privacy Policy (“Policy”)
apply to:

  1. processing of personal data carried out by the Administrator during your use of the website operated by the Administrator ("Website")

  2. processing of personal data by the Administrator during the performance of contracts with business partners

  3. processing of personal data in the fulfillment of the Administrator's legal obligations

  4. processing of personal data of applicants for employment or cooperation and former employees

  5. processing of personal data of temporarily assigned employees through employment agencies

  6. processing of personal data that is necessary for the purpose of protecting the legitimate interests of the Administrator and/or its business partners

  7. processing of personal data carried out by the Administrator on the basis of your consent

​The policy describes the purposes of processing personal data and the way it is processed, informs about the individual categories of processed personal data, their potential recipients, the retention period of personal data and your rights in relation to personal data.

Purposes of personal data processing

​Your personal data may be processed by SOPO companies for the following purposes:

  • Fulfillment of the contract (especially fulfillment of contracts with cooperating persons, fulfillment of contracts with business partners, etc.)

  • Fulfillment of legal obligations (especially obligations in terms of accounting and tax legislation, etc.)

  • Protection of the Administrator's legitimate interest (protection of the rights and legally protected interests of SOPO, e.g. protection of the Internet site and network from misuse, protection of health and property, etc.)

  • Marketing and advertising targeting

SOPO companies are authorized to process the following personal data according to the purpose of processing:

* The administrator is authorized to process your e-mail address in accordance with § 7 paragraph 3 of Act No. 480/2004 Coll., on certain information society services and on the amendment of certain laws (Act on certain information society services), as amended, for for the purpose of disseminating commercial communications regarding own services and products in the event that you have not refused such sending.

Processing of personal data based on consent

If you give SOPO consent to the processing of personal data, you acknowledge that the provision of consent is voluntary and consent can be withdrawn at any time. Consent is granted for a period adequate to the purpose, always stated in the text of the relevant consent or until consent is revoked.

Recipients of personal data

In SOPO companies, your personal data is made available only to authorized employees, or to individual processors of personal data contractually agreed by the Administrator, or to other administrators. However, always only to the extent necessary to fulfill the individual processing purposes and on the basis of the corresponding legal title and guarantee of adequate protection of your privacy. These are, for example, (i) suppliers and service providers (including online services) such as analytical tools, CRM systems, technical services and support, insurance services, logistics services, legal services; (ii) persons processing SOPO's corporate reporting, accounting and business administration, (iii) possibly other third parties who provide or receive services in connection with the fulfillment of SOPO's contractual or legal obligations.

SOPO companies are authorized in cases established by law, or obliged to transfer some personal data on the basis of valid legal regulations, for example to law enforcement authorities or other public authorities.

Personal data of third parties

Personal data of third parties, which means, for example, personal data of employees of the Administrator's business partners and other natural persons participating in cooperation with SOPO (e.g. carriers and employees of carriers), personal data of participants in events organized by the Administrator, or other data that SOPO receives from the business partner in connection with the conclusion or performance of the contract will be processed in accordance with applicable legal regulations in the field of personal data protection. These personal data will be used by the Administrator exclusively for the purpose of fulfilling contracts with business partners. The business partner hereby acknowledges that SOPO will process personal data of third parties for the duration of the contractual relationship and for the period specified by special legal regulations. They will then be stored for a longer period if there is a justified need to store data in connection with a specific case. The business partner is obliged to properly instruct its employees and other persons participating on the business partner's side in cooperation with SOPO companies about the processing of personal data by SOPO companies.

Personal data retention period

We process and store your personal data for the period necessary to ensure all rights and obligations arising from the relevant contractual relationship and for the period during which the Administrator is obliged to store personal data according to generally binding legal regulations. In other cases, the processing time results from the purpose of the processing, for which it must be adequate, or is determined by legal regulations in the field of personal data protection.

RIGHTS OF DATA SUBJECTS

As a data subject, you have the rights listed below, which arise for you from legal regulations, and which you can exercise at any time:

  1. Right of access to personal data: if you want to know if SOPO companies are processing personal data about you, you have the right to obtain information about whether your personal data is being processed and, if so, you also have the right to access your personal data .

  2. The right to correct inaccurate or false personal data: if you believe that SOPO is processing inaccurate or false personal data about you, you have the right to request their correction. SOPO will carry out the repair without undue delay, taking into account the technical possibilities.

  3. Right to deletion: if you request deletion, SOPO will delete your personal data if

    • are no longer needed for the purposes for which they were collected or otherwise processed

    • processing is illegal

    • you object to the processing and there are no overriding legitimate grounds for the processing, or

    • processing does not impose a legal obligation on the Administrator.

  4. The right to limit the processing of personal data: in the event that you are not interested in erasure, but only in the temporary restriction of the processing of your personal data, you can request the Administrator to limit the processing of your personal data.

  5. The right to data portability: if you want SOPO to transfer your personal data, which they process on the basis of your consent or on the basis of a contract, to a third party, you can use your right to data portability. In the event that the exercise of this right could adversely affect the rights and freedoms of third parties, SOPO will not be able to comply with your request.

  6. The right to object: you have the right to object to the processing of personal data that is processed for the purpose of protecting the Administrator's legitimate interests. In the event that SOPO does not prove that there is a serious legitimate reason for the processing that outweighs your interests or rights and freedoms, it will terminate the processing based on your objection without undue delay.

The Administrator reserves the right to reasonably verify the identity of the applicant for the rights in question.
